BREAKING: Supreme Court Rules To Keep Title 42 In Place Indefinitely
Tuesday’s ruling by the U.S. Supreme Court allowed for the preservation of the limit on immigration that was in place during the pandemic, also known as Title 42This law, in effect indefinitely, allows officials to refuse entry to migrants at the border in order to stop the spread of COVID.
Customs and Border Protection officials advised lawmakers that there were approximately 50,000 foreigners waiting to cross into the United States when Title 42 expired. According to The Associated Press, an order from Chief Justice John Roberts stayed a lower court’s ruling, which justices extended to give the court time to consider both sides’ arguments.
Former President Donald Trump used the statute to give commanders-in chief the power to close down immigration in an emergency to prevent communicable disease outbreaks. The lawsuit was filed by families seeking asylum. Judge Emmett Sullivan, U.S. District Court, Washington, D.C., ordered the Biden administration’s lifting of Title 42 by Wednesday.

Leaders at the border have been anticipating an influx from immigrants for some time. Oscar Leeser (Democratic mayor of El Paso Texas) declared a state-of-emergency on Saturday, in anticipation of Title 42’s end. “Our asylum seekers are not safe,” The official said at a press conference. “We have hundreds and hundreds on the street and that’s not the way we treat our people.”
In the past four months, more than 80,000 migrants arrived in El Paso. There are currently 678,000 residents in the city. Winter nights can be below freezing in El Paso. The Department of Homeland Security has previously stated that it would continue to enforce Title 42 until this policy is ended. Alejandro Mayorkas (Homeland Security Secretary) said The agency stated last week that they would “process individuals encountered at the border without proper travel documents using its longstanding Title 8 authorities, which provide for meaningful consequences, including barring individuals who are removed from re-entry for five years.”
