A California Judge Denies John Eastman’s Request to Postpone Disbarment Trial
A California judge has denied John Eastman’s request to postpone his disbarment trial, despite his involvement as a co-defendant in a significant Georgia election fraud racketeering case.
Eastman, a former attorney for former President Donald Trump, argued that his participation in the Georgia proceedings could potentially incriminate himself, which would complicate the disbarment hearing. Additionally, he is an unindicted co-conspirator in a federal election fraud case against Trump in Washington, D.C.
Judge Yvette Roland’s Ruling
Judge Yvette Roland ruled against Eastman’s request, stating that he cannot delay the hearing because he had already begun the proceedings and chose not to invoke the Fifth Amendment during an extensive eight-hour interview earlier in the process. Roland emphasized that Eastman was aware of the possibility of being charged in Georgia when he gave the interview, as he had already been interviewed by the grand jury.
“It is firmly established that a witness cannot choose to testify willingly about a topic during a single legal proceeding and then later claim the right to remain silent under self-incrimination privilege when asked about specific subjects,” Roland wrote. “[Eastman] was completely aware that he had potential criminal exposure for his actions surrounding the 2020 election… yet, respondent gave considerable testimony without ever invoking the Fifth Amendment and did not seek abatement until six days into trial.”
Roland acknowledged that a disbarment case would typically be paused due to criminal charges, but she deemed this case as a “unique circumstance” due to Eastman’s extensive testimony. The California bar aims to revoke Eastman’s law license in the state based on allegations that he encouraged Georgia politicians to create a fraudulent alternate slate of Electoral College votes.
Eastman voluntarily surrendered himself to authorities in Georgia on Tuesday. He is one of 19 individuals, including Donald Trump, indicted by Fulton County District Attorney Fani Willis for their alleged roles in attempting to overturn the 2020 election results in Georgia.
It is important to note that Eastman has not been named in a separate federal case in Washington, D.C., related to the January 6th Capitol riot in 2021, and no federal charges have been brought against him thus far. However, he has been described as a co-conspirator, leaving the possibility of future charges.
The disbarment hearing, which was previously postponed in June due to scheduling conflicts, has now resumed.
