California judge rules that residents have right to ‘state-of-the-art’ handguns
A California judge ruled that residents can exercise their right to possess modern handguns for self-defense purposes. In the U.S. District Court for the Central District of California’s case, California Rifle & Pistol Association v. Bonta, Judge Cormac J. Carney issued a preliminary injunction against the state’s Unsafe Handgun Act and its handgun roster. The judge wrote that the roster fell short of the government’s regulations, resulting in forcing people to rely on models that are over 16 years old.
The judge determined that the roster violated the Second Amendment and stated, “Californians have the constitutional right to acquire and use state-of-the-art handguns to protect themselves. They should not be forced to settle for decade-old models of handguns to ensure that they remain safe inside or outside the home.” Carney dismissed the argument that gun regulations should be solely based on public interest and stressed that these regulations should align with the Constitution and traditional regulations.
To quote the judge, “To justify its regulation, the government may not simply posit that the regulation promotes an important interest. Rather, the government must demonstrate that the regulation is consistent with this Nation’s historical tradition of firearm regulation.”
