A Canadian Father Wins Legal Battle After “Misgendering” His Daughter
A Canadian father who was imprisoned for “misgendering” his gender-confused teenage daughter has achieved a significant victory in the British Columbia Court of Appeal.
The court judgment, issued earlier this month, stated that Robert Hoogland would not have to serve any more time behind bars, and the $30,000 fine imposed on him was dropped.
“This is a huge win because it sets a precedent and serves as a deterrent for parents who are standing up against the trans agenda,” Hoogland said in an interview with The Daily Wire.
Hoogland took legal action after a Canadian children’s hospital informed him in 2018 that his 13-year-old daughter would be given testosterone injections without his consent. In Canada, minors can consent to their own trans treatments, rendering parental consent irrelevant.
Disagreeing with the hospital’s decision, Hoogland believed his daughter needed time and mental health support instead of irreversible transgender medical interventions. Testosterone and other trans treatments have been linked to various health issues.
The court ruled that the girl could proceed with the testosterone treatment and prohibited Hoogland from publicly “misgendering” his daughter. Additionally, a publication ban prevented Canadian media from mentioning Hoogland’s name in any coverage. Hoogland argued that such bans allow people to conceal the harm being done to children, despite claims that trans treatments are beneficial.
Despite the court’s conditions, Hoogland continued to speak out and was subsequently imprisoned for contempt of court, which the Canadian court deemed “family violence.”
“The hardest part is knowing that one day you have a healthy child, and no matter how much you’re fighting to protect that child of yours… all you can simply do is watch the tragedy unfold, and your hands are tied,” Hoogland expressed.
Hoogland served over two months in jail, mostly in solitary confinement. He faced additional attempts to incarcerate him for four more months, but the appeals court ruled in his favor, stating that he would not have to serve any more time or pay the fine.
“To have a punishment that’s six months in prison and a $30,000 fine… not many parents are gonna say, ‘Hey, I’m willing to take that risk,'” Hoogland said, emphasizing the significance of the appeal judgment for other parents.
Regarding his daughter, Hoogland revealed that he has had no contact with her since 2019. He believes his child is “lost,” and his family has been devastated by this ideology and Canada’s legal system.
“It destroys families and it destroyed mine,” he lamented. “I’m hoping one day, when my child realizes… I’m waiting with open arms for that day.”
Hoogland plans to take a break after years of court battles and imprisonment. However, there is a sixty-day period during which the case can be appealed to the Canadian Supreme Court, so the legal battle may continue.
