Republicans Criticize Attorney General Merrick Garland’s Appointment of Special Counsel in Hunter Biden Probe
Republicans have voiced their criticism of Attorney General Merrick Garland’s decision to elevate attorney David Weiss to special counsel status. Weiss has been investigating President Joe Biden’s son, Hunter Biden, and his appointment has raised concerns among GOP members of Congress.
Garland announced on August 11 that Weiss, who serves as the U.S. Attorney for the United States District Court for the District of Delaware, has been designated as a special counsel. This move came just three days after Weiss, who was appointed under President Donald Trump, requested the special counsel designation.
The decision to appoint Weiss as special counsel follows allegations made by two IRS whistleblowers. They claim that Weiss has faced restrictions from the Department of Justice (DOJ) in filing certain charges against Hunter Biden and that there has been political interference in the DOJ’s investigation of the president’s son.

Weiss will now serve as special counsel ”for the ongoing investigation and prosecutions referenced and described in United States v. Robert Hunter Biden, as well as for any other matters that arose or may arise from that investigation,” according to a release from the Department of Justice.
House Oversight Committee Chairman James Comer (R-Ky.) criticized the appointment, stating, “This move by Attorney General Garland is part of the Justice Department’s efforts to attempt a Biden family coverup in light of the House Oversight Committee’s mounting evidence of President Joe Biden’s role in his family’s schemes selling ‘the brand’ for millions of dollars to foreign nationals.”
Comer pledged that his committee, along with the House Judiciary Committee, will work to uncover misconduct at the Justice Department and hold those responsible for abusing law enforcement powers accountable.
The House Judiciary Committee also condemned Garland’s decision, calling it a coverup. Russell Dye, spokesperson for committee Chairman Jim Jordan (R-Ohio), stated, “David Weiss can’t be trusted, and this is just a new way to whitewash the Biden family’s corruption.”
The plea deal that Weiss had previously negotiated with Hunter Biden has now been scrapped, as confirmed by a filing from the DOJ on August 11. Consequently, the case will proceed to trial. The plea deal involved Hunter Biden pleading guilty to tax evasion and a gun charge, with the latter charge being deferred pending completion of a drug program.
The plea deal fell apart during a contentious hearing in July, when U.S. District Judge Maryellen Noreika expressed concerns about linking tax crimes to resolving felony gun charges, describing it as atypical and unprecedented.
In recent months, two IRS whistleblowers have come forward, alleging political interference in the DOJ’s investigation of Hunter Biden’s tax affairs. These revelations have further fueled GOP criticism of the probe.
House Speaker Kevin McCarthy (R-Calif.) also dismissed the appointment as a positive development, cautioning that it should not be used to obstruct congressional investigations or cover up the Biden family’s corruption.
Several other Republican representatives, including Rep. Ralph Norman (R-S.C.), Rep. Troy Nehls (R-Texas), Rep. John Rose (R-Tenn.), and Rep. Andrew Clyde (R-Ga.), expressed their distrust of Weiss and criticized the appointment as an attempt to conceal the Biden family’s corruption.
On the other hand, Rep. Byron Donalds (R-Fla.) expressed hope that Weiss’s appointment as special counsel would lead to greater accountability for the Biden family and the administration.
