“DOE does not seem to dispute this data; in fact, in 2020, DOE appeared to acknowledge that the frustratingly slow pace of modern dishwashers led consumers to substitute them with hand-washing. And nothing wastes water and energy like hand-washing: DOE itself estimated in 2011 that hand-washing consumes 350% more water and 140% more energy than machine-washing.”
CEI attorney Devin Watkins celebrated the court’s decision, stating, “In this opinion, the court has compelled the DOE to abide by the law and even noted that one of the DOE’s positions in this lawsuit ‘borders on frivolous.’ This ruling allows manufacturers to create superior dishwashers without being burdened by counterproductive federal regulations.”
Will Hild, the Executive Director of Consumers’ Research, added, “This is a significant victory for consumers and a major blow to the Biden administration’s attempts to enforce their ESG agenda through regulation. These regulations had nothing to do with ‘saving the environment’; their primary objective was to enforce compliance with the ESG agenda.”
