A Washington D.C. federal judge reinstated a gag order on former President Donald Trump Sunday evening in a motion that largely agreed to Special Counsel Jack Smith’s arguments.
“Contrary to Defendant’s argument, the right to a fair trial is not his alone, but belongs also to the government and the public,” Judge Tanya Chutkan wrote in court filing.
Chutkan had temporarily suspended the gag order she imposed after a request from the Trump legal team. But Chutkan reimposed the order after Smith and his team highlighted a Truth Social post from Trump regarding a news report that the former White House chief of staff took a deal to testify in the Georgia election case.
“The statement singles out a foreseeable witness for purposes of characterizing his potentially unfavorable testimony as a “lie” “made up” to secure immunity, and it attacks him as a “weakling and coward” if he provides that unfavorable testimony—an attack that could readily be interpreted as an attempt to influence or prevent the witness’s participation in this case,” Chutkan wrote.
Trump criticized the decision to reinstate the gag order on Truth Social
“This order, according to many legal scholars, is unthinkable,” wrote Trump. “It illegally and unconstitutionally takes away my First Amendment Right of Free Speech, in the middle of my campaign for President, where I am leading against BOTH Parties in the Polls.”
“It will not stand,” Trump concluded.
In his ongoing New York civil case, Trump was fined $10,000 last week after the judge claimed that the 45th president violated the gag order in the case.

As the legal battles surrounding former President Donald Trump continue, a federal judge in Washington D.C. has reinstated a gag order on Trump, preventing him from publicly discussing the ongoing cases against him. This decision comes after Special Counsel Jack Smith argued in favor of the order.
Judge Tanya Chutkan, in her court filing, stated that the right to a fair trial belongs not just to the defendant, but also to the government and the public. The gag order is meant to ensure that the legal proceedings are not influenced or prejudiced by public statements, potentially impacting witness participation and the overall integrity of the case.
Initially, the gag order was temporarily suspended at the request of the Trump legal team. However, it was reinstated after Smith and his team highlighted a post from Trump on his social media platform, Truth Social. In the post, Trump commented on a news report regarding the former White House chief of staff’s involvement in the Georgia election case. Chutkan deemed Trump’s comments as potentially influencing or preventing the witness’s participation in the case.
Trump, in response to the reinstatement of the gag order, criticized the decision as a violation of his First Amendment right to free speech. He argued that it is unprecedented and unconstitutional to restrict his ability to express his opinions during his campaign for the presidency.
Despite Trump’s objections, the gag order stands. The judge’s decision is supported by legal scholars who believe it is necessary to maintain the integrity of the legal process.
In addition to the gag order, Trump is facing consequences in his ongoing civil case in New York. Recently, he was fined $10,000 for violating the gag order in that particular case.
As the legal battles continue, it is important to stay informed about the developments surrounding these cases. You can do so by subscribing to our newsletter to receive breaking news updates directly to your inbox.
Trump remains determined to fight against the gag order and is confident that it will not stand. The outcome of his legal battles will undoubtedly have significant implications for not only him but also for the future of presidential accountability and the limits of free speech.
