A Boston city councilwoman agreed Tuesday to plead guilty to federal public corruption charges after allegedly using an inflated bonus to pay a relative in a kickback scheme.
Democrat Tania Fernandes Anderson was arrested by FBI agents in December on six felony charges, including five counts of wire fraud and one count of theft concerning federally funded programs related to the alleged kickback scheme that earned her thousands of taxpayer dollars.
According to the agreement reached Tuesday, Fernandes Anderson is set to plead guilty to one count each of wire fraud and theft associated with a program granted federal funding, according to a release from the U.S. Attorney’s Office for the District of Massachusetts. Four counts of wire fraud were dropped against her.
“The charge of wire fraud provides for a sentence of up to 20 years in prison, three years of supervised release, and a fine of up to $250,000. The charge of theft concerning programs receiving federal funds provides for a sentence of up to 10 years in prison, three years of supervised release, and a fine of up to $250,000,” the release says. “Sentences are imposed by a federal district court judge based upon the U.S. Sentencing Guidelines and statutes which govern the determination of a sentence in a criminal case.”
Fernandes Anderson said she also intends to resign her seat on the City Council.
“I have decided to plead guilty and resolve the case brought against me,” she said in a statement from her attorney, according to a report. “I would like to apologize to my constituents, supporters, and all who have been impacted. Please forgive me.”
“In the coming days, I will evaluate transition plans and timeline with the District 7 Advisory Council,” the statement continues. “I will do everything possible to make an orderly exit to ensure my constituents’ needs are met.”
Fernandes Anderson faced financial difficulty in 2023, which partly stemmed from a sanction imposed by the State Ethics Commission for hiring immediate family members, former attorney Joshua Levy said at the time of her arrest.
“In and around that same time in 2023, Miss Fernandes Anderson, the grand jury alleges, hatched this scheme to funnel bonus payments, taxpayer money, into her own pocket, in the tune of approximately $7,000,” he said.
The indictment against Fernandes Anderson alleged that she told “Staff Member A” that they would receive a bonus of $13,000 contingent on a $7,000 kickback.
“On or about June 9, 2023, at approximately 4:11 p.m., Staff Member A texted Fernandes Anderson, ‘Bathroom’ to let FERNANDES ANDERSON know that Staff Member A was waiting in the bathroom to hand the $7,000 cash to FERNANDES ANDERSON,” the indictment said. “Within seconds, FERNANDES ANDERSON texted Staff Member A, ‘Ready’ to confirm that Fernandes Anderson was ready to accept the $7,000 cash kickback from Staff Member A.”

“Shortly following these texts, Staff Member A handed FERNANDES ANDERSON approximately $7,000 in cash at a bathroom in City Hall,” it noted.
All of the funds were the product of Boston taxpayers, according to prosecutors.
