Top Democrats Support Disqualifying Trump from Running in 2024
According to Axios, two prominent Democrats, Reps. Adam Schiff of California and Tim Kaine of Virginia, have voiced their support for the theory that former President Donald Trump could be disqualified from running in the 2024 election under the 14th Amendment.
Section 3 of the 14th Amendment states that anyone who “engaged in insurrection” cannot hold elected office. Schiff and Kaine believe that Trump’s actions during the Capitol attack on January 6, 2021, qualify as insurrection and therefore disqualify him from running for office.
Free Speech For People, a Democratic-aligned group, has also sent letters to secretaries of state in key 2024 states, urging them to remove Trump from the ballot.

Schiff, speaking on MSNBC’s “Inside with Jen Psaki,” stated that disqualifying Trump “fits Donald Trump to a T.” He emphasized that engaging in acts of insurrection or rebellion against the government, or providing aid and comfort to those who do, should result in disqualification, regardless of a conviction.
Kaine, in an interview with ABC News, also expressed support for disqualification, arguing that the attack on the Capitol was intended to disrupt the peaceful transfer of power outlined in the Constitution. He acknowledged that the matter will likely be resolved in the courts.
However, not everyone agrees with this theory. Jonathan Turley, a law professor at George Washington University, called it “the single most dangerous constitutional theory” he has seen in decades. Hans von Spakovsky, a senior legal fellow for The Heritage Foundation, argued that Section 3 of the 14th Amendment is no longer in effect and that Trump has never been convicted of insurrection or rebellion.
While the debate continues, some legal experts, such as Cornell Law School professor William A. Jacobson, caution against allowing state officials to determine what constitutes insurrection, as it could have significant implications for the presidential electoral system.
