Tiana Lowe Doescher claimed Wednesday that Republicans could take legal action if President Joe Biden’s replacement is not Vice President Kamala Harris.
A growing number of Democrats have called on Biden to step aside from the 2024 presidential ticket, citing his underperformance at last week’s presidential debate. Doescher, a commentary writer for the Washington Examiner, explained that anyone besides Harris replacing Biden would “rob” voters of their choice of a Biden-Harris ticket.
“I mean, it’s why you should expect the Republican Party to start filing legal challenges if they do try and move Biden off the ballot, and especially if they try to replace him with someone other than Kamala Harris, right?” Doescher said on Fox Business’s Cavuto: Coast to Coast. “Because, legally, since they are a ticket, they are more combined. And Joe Biden has 99% of the delegates, right? It’s very difficult to rob the voters of that choice.”
Doescher added it is possible for the Democratic Party to find “a miracle consensus candidate” before the 2024 election. However, an attempt by the party to “leapfrog the first female, black, and Asian vice president” would likely not go over well.
David Carlucci, a former Democratic state senator from New York, argued Republicans are focusing too much on Biden’s mental acuity and that this overfocus could hurt them in the unlikely event that Biden is replaced. Doescher contended that younger voters would stick with former President Donald Trump because they remember how the economy was under his leadership, prompting her and Carlucci to interrupt and talk over each other before host Neil Cavuto stepped in.
Doescher’s prediction about Harris being skipped over in replacing Biden comes after California Delegate Areva Martin argued that black women such as herself would “blow up” the Democratic Party if Harris is not Biden’s replacement. She did argue, however, that it is too late to swap Biden out for someone else and that Democrats need to “stay the course” with the president.
Trump, the presumptive presidential nominee for the Republican Party, stated late last year that he believes Harris would be a better president than Biden, as he did not think “you can have worse than him.”

Polling data released by CNN, which was conducted over the weekend after the network’s presidential debate, found that Harris performed better against Trump in a hypothetical matchup than Biden, with Harris at 45% of support from respondents against Trump with 47%. Against Biden, Trump received 49% of support while the incumbent received 43%.
The data surveyed a total of 1,274 respondents and had a margin of error of 3.5%.
