Doctor Who Tried to Save Ashli Babbitt on Jan. 6 Charged With 2 Felonies, 2 Misdemeanors for Time at the U.S. Capitol
California doctor who helped the mortally injured Ashli Babbitt After she was shot in the House of Representatives Jan. 6, 2021 was taken into custody by the FBI for four criminal charges stemming out of his time at U.S. Capitol.
Dr. Austin Brendlen Harris was 42 years old and is from Granada Hills, California. He was taken into custody Jan. 25, in Van Nuys.
Harris was charged in a criminal complaint in Washington D.C. with knowingly entering or remaining in a restricted building or grounds without authority, and disorderly and disruptive conduct in a restricted building or grounds—both felonies with sentences of up to 10 years in prison. He was also charged with disorderly conduct, and parading, demonstrating or picketing in a Capitol building—both misdemeanors.
Harris is the owner of NeuroRelief Ketamine and Infusion Therapy in Sherman Oaks. He is a certified cardiothoracic anesthesiologist.
Harris treated Babbitt’s gunshot wound for four minutes after U.S. Capitol Police Lt. Michael Byrd shot her at about 2:45 p.m. that day. Harris came from the hallway crowd and helped Babbitt when she fell from the window frame into which she was climbing.
A video journalist with medic training also tended to Babbitt before police drove both men from the hallway outside of the Speaker’s Lobby.
Harris was on his knees checking Babbitt’s upper chest wound when a U.S. Capitol Police bicycle officer reached down and grabbed him by the shoulders. Harris was wrestled away by the officer, who grabbed his jacket and shoved him down a hallway.

Harris and Harris struggled to the end of the corridor as the visibly furious officer continued pushing Harris. It’s impossible to hear what was said between the men because the crowd was yelling at the police.
“You did that! You did that!” One protester shouted. “You guys shot her!”
Harris asked the officer to retrieve Babbitt’s medical bag. Harris then returned to Harris. He was handed the bag by the officer.
Police carried Babbitt, who was still conscious, down the steps to South Entrance. There, an FBI medic and others attempted to save her while a rescue team arrived. At 3:15 pm, she was declared dead by a D.C. hospital.
According to the U.S. Department of Justice’s statement of facts, Harris entered Capitol at 2:15 p.m. through Senate Wing Doors and headed towards the Crypt which is one floor below the Rotunda.
“He attempted to bypass the line of officers and appeared to engage in a verbal confrontation with officers,” The charging document stated.
Harris was just a few moments earlier on the Lower West Terrace near the Inauguration Platform. “He can be overheard comparing the officers to Nazis,” The statement was read. The statement did not contain a direct quote nor provide details about who made the comment.
Prosecutors included a screen capture of a post from Harris’s Facebook page. Harris stated that he spent the day on Facebook. “treating trauma patients at the Capitol building.”
He also stated his belief that chaos at the Capitol was the result of “Antifa dressed up like Trump supporters.”
“It is a false-flag event to allow even more oppression of conservatives,” He wrote. “I am so sad for our country. So much deceit, such a craving for absolute power by the swamp establishment has led to our election integrity becoming a joke, that a 90-pound unarmed woman was gunned down by Capitol Police being absolutely no threat.”
