Former President Donald Trump has filed a motion on Friday, seeking to transfer his 14th Amendment case in Colorado from state to federal court. The case was brought forward by the Citizens for Responsibility and Ethics in Washington on behalf of Republican and independent citizens who believe Trump should be disqualified from the 2024 presidential ballot in Colorado under the 14th Amendment.
Urgent Public Interest in Determining Trump’s Eligibility
In a notice of removal, Trump’s legal counsel emphasized the urgent public interest in promptly resolving the question of Trump’s constitutional eligibility to serve as president, especially with the approaching primary election. The case has garnered significant attention as it could have implications for Trump’s potential candidacy in the future.
However, the office of Colorado Secretary of State Jena Griswold responded to Trump’s notice, stating that the state courts are well-equipped to address 14th Amendment questions and that they are currently exploring legal options.
A Widespread Effort to Keep Trump Off the Ballot
The lawsuit in Colorado is part of a broader effort from individuals on both sides of the political spectrum to prevent Trump from appearing on the ballot. Similar initiatives are underway in states like New Hampshire, Arizona, Michigan, and Florida.
Advocacy group Free Speech for People has sent letters to top election officials in nine states, urging them to exclude Trump from the ballot. These efforts stem from the belief that Trump’s actions to overturn the 2020 election, for which he is facing state and federal indictments, meet the criteria outlined in the 14th Amendment.
Trump Denies Wrongdoing and Calls Efforts a Political “Trick”
Trump has vehemently denied any wrongdoing and has dismissed the efforts to remove him from the ballot as a political ploy with no legal basis. His campaign spokesperson, Steven Cheung, criticized the pursuit of this “absurd conspiracy theory” and likened it to the actions of political prosecutors in New York, Georgia, and DC.
As the legal battle unfolds, the question of Trump’s eligibility under the 14th Amendment remains a contentious issue, with both sides fiercely advocating for their positions.
