Fulton County, Georgia District Attorney Indicts Donald Trump and Alleged Co-Conspirators
Fulton County, Georgia District Attorney Fani Willis made a stunning announcement, accusing former President Donald Trump and 18 others of attempting to “seize” a presidential term. The indictment, which includes 13 charges against Trump, including racketeering charges related to the 2020 election, was unsealed after being presented to a grand jury convened by Willis in May 2022.
Charges Filed: RICO Charges for 2020 Election
Under Georgia’s Racketeer, Influenced, and Corrupt Organizations (RICO) Act, each individual named in the indictment is accused of participating in a criminal enterprise to help Trump unlawfully claim the presidency. The indictment alleges that these individuals took various actions in Georgia and beyond to obstruct the counting of certified votes from the 2020 general election, where the presidential electors were declared winners.
Willis emphasized that the defendants have until noon on August 25th to surrender themselves to authorities in Fulton County, Georgia.
Defendants’ Opportunity to Surrender
“Rather than following Georgia’s legal process for election challenges, the defendants are accused of engaging in a criminal racketeering enterprise to overturn the presidential election result,” Willis stated. Following the indictment, the grand jury issued arrest warrants for the charged individuals. Willis has given them the chance to voluntarily surrender by noon on August 25th, 2023.
Willis reiterated that all defendants are presumed innocent until proven guilty. She plans to file a proposed scheduling order to the court, aiming for a trial within the next six months.
When asked about a “fictitious document” that appeared on the clerk’s website earlier in the day, Willis declined to comment or speculate. The document bore a striking resemblance to the unsealed indictment revealed later that night.
Trump Faces Multiple Indictments
This year alone, Trump has been indicted in three other jurisdictions. In March, he was indicted in Manhattan for alleged falsification of business records. In June, he faced federal charges in Florida for mishandling classified documents. Earlier this month, he was federally indicted in Washington, D.C., for his alleged attempts to overturn the 2020 election.
2024 Presidential Primary and Potential Rematch
Despite the legal challenges, Trump remains the front-runner in the 2024 Republican presidential primary, leading all other candidates by nearly 40% according to the RealClearPolitics polling average. If he secures the GOP nomination, it could set the stage for a rematch against President Joe Biden, the current front-runner on the Democratic side.
