Former President Donald Trump Charged in Case Surrounding Alleged Election Subversion
Special counsel Jack Smith announced on Tuesday that former President Donald Trump has been charged with four counts in a case related to alleged efforts to subvert the 2020 election and disrupt the peaceful transfer of power in January 2021.
“The attack on our nation’s capitol on Jan. 6, 2021, was an unprecedented assault on the seat of American democracy,” Smith said. “It was fueled by lies by the defendant targeted at obstructing a bedrock function of the U.S. government.”
Charges and Indictment Details
The four federal charges include:
- Conspiracy to Defraud the United States
- Conspiracy to Obstruct an Official Proceeding
- Obstruction of, and Attempt to Obstruct an Official Proceeding
- Conspiracy Against Rights
The indictment, handed up by a federal grand jury, states that Trump knowingly conspired with co-conspirators to injure, oppress, threaten, and intimidate individuals in the exercise of their constitutional right to vote and have their votes counted. The conspiracy allegedly took place from November 14, 2020, to January 20, 2021, in the District of Columbia and elsewhere.
While the indictment does not mention the co-conspirators by name, it identifies them as attorneys and a “Justice Department official” who attempted to use the DOJ to open sham election crime investigations and influence state legislators with false claims of election fraud. Another co-conspirator is described as a political consultant who helped implement a plan to submit fraudulent slates of presidential electors to obstruct the certification proceeding.
Additional Charges
This is the second federal indictment that Trump faces as part of Smith’s investigation. He is also facing charges in a separate case, including willful retention of national defense information, conspiracy to obstruct justice, and false statements. On July 27, Trump was charged with three additional counts as part of a superseding indictment in that case.
