Rep. Matt Gaetz Seeks to Censure and Investigate Judge Handling Trump’s Court Case
Rep. Matt Gaetz (R-FL) has introduced a resolution aiming to censure and investigate the judge presiding over one of former President Donald Trump’s court cases. The resolution targets U.S. District Judge Tanya Chutkan, who is overseeing the case related to Trump’s alleged efforts to undermine the 2020 election results and his alleged involvement in the January 6 Capitol riot. Gaetz claims that Judge Chutkan is openly biased against Trump.
Accusations of Bias and Political Motivations
Gaetz expressed deep concern over what he perceives as Judge Chutkan’s blatant political bias from the bench. He stated, “It is deeply concerning that a United States District Court judge would exhibit such blatant political bias from the bench.” Gaetz further criticized Judge Chutkan for what he sees as extreme sentencing of January 6 defendants while openly supporting the violent Black Lives Matter riots of 2020. He believes that her actions demonstrate a complete disregard for impartiality and the rule of law, emphasizing that justice may be blind, but the American people are not.
Resolution Condemning Judge Chutkan
The resolution introduced by Gaetz condemns Judge Chutkan’s alleged support for the Black Lives Matter riots and her donations to former President Barack Obama, who appointed her to the court. In 2021, Chutkan dismissed comparisons between the BLM riots and the January 6 riot, stating that it is a “false equivalency” that ignores the real danger posed by the Capitol Hill incident to the foundation of democracy.
Calls for Recusal and Trump’s Accusations
Several prominent conservatives have called for Judge Chutkan’s recusal, claiming that she has been particularly harsh with the January 6 rioters, even those without prior arrests. Former President Trump himself has criticized Chutkan and accused her of wanting to see him imprisoned.
Gaetz’s resolution comes on the heels of a request from Trump’s legal team to delay the trial until April 2026, citing the need for more time to review the extensive documents gathered by the Justice Department over the past two years. The legal team argued that four months would not be sufficient to thoroughly examine the evidence.
House Judiciary Committee Investigation
In addition to the censure resolution, Gaetz’s resolution also calls on the House Judiciary Committee to launch an investigation into Judge Chutkan.
