Eric Schmitt says Boasberg ‘inserted himself’ in case against Trump deportations – Washington Examiner
Senator Eric Schmitt (R-MO) has accused Judge james Boasberg of overstepping his authority in a legal case involving deportations during the Trump management. Schmitt asserts that Boasberg “inserted himself” into the case, despite not being the designated emergency judge at the time it was filed at 2:30 AM. He suggests that this situation warrants further examination and calls for potential legislative changes to ensure a fairer random assignment of judges.
Schmitt criticized the unprecedented legal challenges facing the Trump administration, attributing their origin to “liberal activist judges” who he believes have an excessive influence on political matters. He stated that Boasberg’s actions in this case may indicate he was tipped off inappropriately, supporting his contention that activist judges are deliberately intervening in administration cases.
In response to these ongoing legal struggles, Attorney General pam Bondi referred to the numerous lawsuits against the administration as a “constitutional crisis,” while fellow Senator Josh Hawley (R-MO) condemned the ability of judges to issue nationwide injunctions, arguing that they should only apply to the parties involved in specific cases.
Eric Schmitt says Boasberg ‘inserted himself’ in case against Trump deportations
Sen. Eric Schmitt (R-MO) said that Judge James Boasberg “inserted himself” into the case about deportations carried out by the Trump administration, adding that “further investigation” is required.
Schmitt described how the legal challenges that President Donald Trump and his administration are facing from “liberal activist judges” are unprecedented, saying the judges are playing an “outsized” role in deciding the nation’s politics.
One of the judges that the administration is feuding with is Boasberg. Schmitt said it was revealed over the weekend that Boasberg is “not the emergency judge” in Washington, D.C.
“He inserted himself in that role,” Schmitt said on Fox News’s The Faulkner Focus. “He was on vacation. The case was filed at 2:30 in the morning, somehow he ended up with that case. He wasn’t the emergency judge on duty, so I think this requires further investigation and legislation.”
Schmitt continued by arguing that emergency judges “100% of the time” receive these kinds of cases and suggested it is possible Boasberg was “tipped off.” He added that this “unusual” measure represents the actions that “activist judges” are taking to play a role in the cases against the Trump administration.
The Missouri senator urged Chief Justice John Roberts to look into it. Schmitt also said he would file legislation himself to enforce “randomness” when assigning judges to cases, noting that voters “don’t think it’s random at all.”
JUDGE REJECTS TRUMP ADMINISTRATION ATTEMPT TO DISMISS ORDER TO RETURN MISTAKENLY-DEPORTED MAN
Attorney General Pam Bondi vented her frustration over the legal feuds the Trump administration is facing, deeming the 170 lawsuits against the administration a “constitutional crisis.” One fight that Bondi highlighted is with the administration’s planned ban on transgender troops from serving in the military, an effort blocked by two judges.
Sen. Josh Hawley (R-MO), like many of his fellow Republican senators, has condemned the legal fights against the White House. Hawley specifically criticized how judges are using injunctions on a national scale, arguing these can only be issued “to the parties in front of them” rather than the nation as a whole.
