Former Trump Lawyer May Not Face Charges in Ongoing Investigation
“Not at all. I think this is a case where, you know — you have to evaluate every case based on what are the facts and the law and is it something that’s provable, but there’s also the other atmospherics, is this something that from a discretion point of view, is this something where a prosecution makes sense? Is it something where it is a slam dunk case where some of these things could be interpreted a few different ways?”
“And also when it comes to a specific issue like this, where we are talking about potentially national defense information. Is it the type of thing where they want to declassify these things if they haven’t already been declassified and put them out publicly?”
“Classification is not binding; you have to actually take these documents, show them to the jury, and then prove to them that it constitutes national defense information.”
Timothy Parlatore, a former lawyer for former President Donald Trump, recently spoke on NBC News’s Meet the Press about the ongoing investigation by special counsel Jack Smith into Trump’s alleged mishandling of classified documents and his alleged role in the Capitol riot on Jan. 6, 2021. Parlatore pointed out that Trump may not be charged, citing the lack of prosecution in the Hillary Clinton email case in 2016.
Why Trump May Not Be Charged
Parlatore explained that every case must be evaluated based on the facts and the law, and whether it is provable. He also mentioned the discretion of prosecution and whether it makes sense to pursue a case. In addition, he noted that classification is not binding and that the prosecution must prove that the documents constitute national defense information.
Parlatore drew a parallel between Trump’s case and Clinton’s case, stating that even if Trump did what he is accused of, there are reasons why he may not be prosecuted. He also mentioned the possibility of declassifying the documents and making them public.
What the Investigation Entails
Smith was appointed by Attorney General Merrick Garland in November 2022 to investigate Trump’s alleged mishandling of classified documents and his alleged role in the Capitol riot on Jan. 6, 2021. A recent report suggested that an audio recording of Trump exists from Summer 2021 where he discusses having a classified document in his possession regarding a potential attack from Iran.
