Kelly reiterated that Trump’s lawyers informed Judge Cannon that they had evidence of collaboration between the Biden White House, NARA, DOJ, and intelligence agencies to determine which documents to include in Jack Smith’s indictment.

Just the News reported in August 2022 that the Biden White House worked directly with the Justice Department and the National Archives to initiate the criminal probe into Trump. Government documents obtained by the news outlet showed that the White House Deputy Counsel was engaged in conversations with the FBI, DOJ, and National Archives as early as April. The White House counsel informed the National Archivist that President Biden would not object to waiving executive privilege, allowing the DOJ to subpoena Trump for any remaining materials from his presidency.
Trump’s lawyers received a letter from the acting National Archivist, stating that the White House had requested the FBI’s access to the documents for review. The letter also mentioned that Biden empowered the National Archivist to determine whether to uphold Trump’s claim of executive privilege, which she decided not to honor.
Harvard Law School professor emeritus Alan Dershowitz expressed surprise at the Biden White House’s decision to waive Trump’s executive privilege, stating that it undermines the concept of privilege and raises concerns about future presidents’ privacy.
Kelly also noted that the start date for Trump’s classified documents trial in May 2024 may be pushed back due to various issues, including discovery delays and conflicting trial schedules. Judge Cannon expressed doubts about the feasibility of completing the work within the compressed timeframe.
