Judge Blocks Biden Admin From Releasing Migrants Without Court Dates
The Facts Inside Our Reporter’s Notebook
Federal Judge Blocks Biden Administration’s Plan to Release Migrants Without Court Dates
A federal judge has put a halt to the Biden administration’s plan to release migrants without setting court dates. The plan would have allowed U.S. Customs and Border Protection to release migrants on parole if they were unable to accommodate a large influx of migrants. However, Judge T. Kent Wetherell II’s decision means that the administration must wait two weeks before implementing the plan due to a judicial restraining order.
Florida Attorney General Ashley Moody challenged the policy, arguing that it was effectively the same approach as a policy that Wetherell had already rejected in March. Parole is a process by which a migrant may receive a speedy release into the U.S. interior without receiving a court date to address their asylum claim. It is normally applied for emergency humanitarian reasons.
The ruling comes as the Title 42 immigration order is set to expire. The order allowed border authorities to swiftly deport migrants from countries known to host communicable diseases. With the order’s termination, fears of a major migration surge have arisen, with tens of thousands of would-be asylum seekers already arriving at the border.
