Federal Judge Gives Gov. DeSantis a Major Win in Protecting Women’s Sports
A federal judge has delivered a significant victory to Florida Governor Ron DeSantis in his fight to preserve the integrity of women’s sports in the state and prevent the encroachment of transgender ideology.
In 2021, DeSantis signed the Fairness in Women’s Sports Act, which aimed to ensure that girls and women participating in school sports programs would not have to compete against male athletes.
The law, known as Senate Bill 1028, was challenged in court by a male student from Broward County who was barred from playing on a girls’ high school soccer team.
The student argued that SB 1028 violated the Equal Protection Clause of the 14th Amendment.
However, Judge Roy Altman, appointed by President Donald Trump, ruled that not all gender-based classifications violate the Equal Protection Clause and that Florida’s separation of males and females in school sports is justified in promoting women’s athletics.
The plaintiff also claimed that SB 1028 violated federal Title IX rules and infringed on his right to privacy by requiring him to disclose sensitive medical information.
However, the judge dismissed these arguments, stating that the potential harm to the plaintiff was too speculative and that the word “sex” in Title IX does not cover “gender identity.”
Other states have also taken steps to protect women’s sports. In 2022, the Kentucky Legislature overrode the governor’s veto to pass a bill prohibiting males from competing in women’s sports. Similarly, Indiana’s governor’s veto of a similar bill was overturned last year.
Texas and South Dakota have also enacted laws that prioritize biological sex over gender identity in school sports participation.
