Florida Approves New Rules for Bathroom Use in Colleges
Officials in Florida have recently implemented new regulations that dictate which bathrooms college teachers and students can use, imposing strict penalties for any violations. The Florida State Board of Education has adopted rules that require the Florida College System to designate restrooms and changing facilities for exclusive use by males or females based on their biological sex. This means that transgender individuals cannot use facilities that align with their gender identity.
The rules also state that institutions must establish a disciplinary policy to address any personnel who violate these regulations. The disciplinary actions may include verbal warnings, written reprimands, suspension without pay, and termination. A second documented offense will result in immediate termination.

Institutions are required to thoroughly investigate each complaint regarding rule violations, document the incidents, and retain the documentation according to their retention policies. The documentation should include the offender’s name, the person who reported the violation, and the circumstances surrounding the incident.
The new rules also apply to students, encompassing campuses, centers, special purpose centers, and student housing facilities owned by the institution. By April 1, the president of each college system institution must submit a “Safety in Private Spaces Act Compliance Certification” form to the education department, confirming their adherence to the rules.
These regulations were established as a result of House Bill 1521 (HB 1521), signed into law by Republican Governor Ron DeSantis in May. The bill prohibits individuals from willfully entering restrooms or changing facilities designated for the opposite sex and considers it an offense if they refuse to leave when asked to do so. It applies to K-12 educational institutions, detention facilities, locker rooms, and all public buildings.
Ensuring Student Safety
Supporters of the gender-restricted bathroom rule argue that it is necessary to ensure the safety of students. However, opponents claim that it harms transgender individuals and the LGBT community. Carlos Guillermo Smith, a former Florida state representative, criticized the new rule, stating that it creates a hostile environment for trans people in the state.
During a press conference, Governor DeSantis emphasized that HB 1521 aims to protect women’s safety. He stated, “A woman should not have to worry about someone from the opposite sex being in their locker room. We want to make sure that our girls and our women are protected.”
The bill allows individuals who believe an institution has failed to implement the rules to file a complaint with the attorney general. The attorney general can then bring a civil action and seek injunctive relief. If an institution is found to have willfully violated the law, the attorney general can impose a fine of up to $10,000.
While HB 1521 specifies the need for gender-specific bathrooms, it does not outline the specific reprimands for violations. Each educational institution is responsible for establishing disciplinary procedures within their code of student conduct.
Pennsylvania Transgender Bathroom Controversy
Florida’s decision to segregate bathrooms by gender coincides with a controversy in a Pennsylvania school district. The district is currently dealing with a situation involving its transgender tennis coach, David “Sasha” Yates, and his use of bathrooms.
Mr. Yates, who began dressing as a woman and changed his name to Sasha, is alleged to have entered the girls’ bathroom and disrobed in front of the girls’ soccer team in the student locker room. The board of the Gettysburg Area School District was scheduled to vote on whether to renew Mr. Yates’ contract, but the vote did not take place.
It is clear that the issue of bathroom use for transgender individuals continues to be a topic of debate and contention in various parts of the United States.
