Former ACLU Employee Files Lawsuit Alleging Discrimination Based on Race and Sex
A former employee of the American Civil Liberties Union (ACLU) is taking legal action against the organization, claiming she experienced discrimination based on her race and sex. Monica Espitia, an immigrant from Colombia, recently filed a lawsuit against ACLU Hawaii, accusing them of engaging in a “pattern of discriminatory and retaliatory conduct.” The lawsuit, spanning 25 pages, highlights a violation of the organization’s own code of conduct regarding diversity.
“In practice, however, while Plaintiff was asked to publicly hold government officials accountable to one standard regarding implicit bias, inequitable treatment, and free speech, she was required to remain silent and accept the opposite standard regarding these matters at the workplace of the ACLU-HI,” the filing stated.
Espitia began working for various ACLU branches in 2005 and joined the Hawaii branch in 2019 as the smart justice campaign director. This role focuses on reducing incarceration rates and addressing racial bias within the justice system. The lawsuit alleges that Espitia faced discrimination from Josh Wisch, a white man, who accused her of favoring a Native Hawaiian woman over him for a position. It also claims that Wisch redirected funds from Espitia’s campaign budget to an unrelated cause and expressed a lack of confidence in her leadership during a diversity, equity, and inclusion meeting.
The lawsuit further accuses Ryan Leong, a native Hawaiian, of mistreating Espitia by assigning her unnecessary and tedious tasks and responding with angry outbursts when questioned. It states that Leong turned other directors against Espitia, ultimately leading to her termination following a ”conflicted and retaliatory investigation and report” conducted by Leong.
Throughout her last year at the organization, Espitia reached out to the national ACLU twice but received no response. Her firing occurred one month after she filed a complaint with the Hawaii Civil Rights Commission.

Espitia, who worked for the ACLU as a legal assistant for six years, alleges that throughout her tenure she faced unfair treatment and unequal opportunities due to her gender and ethnicity. She asserts that her colleagues regularly made offensive remarks, stereotyping and mocking her based on her Colombian background. Furthermore, she claims that she was repeatedly passed over for promotions and denied training opportunities that were offered to her white counterparts.
The lawsuit also highlights instances of retaliation Espitia faced after she voiced her concerns regarding the discriminatory behavior she experienced. She was allegedly marginalized, isolated, and discredited within the organization, leading to a hostile work environment.
Such allegations are deeply troubling, particularly when they involve an organization like the ACLU that prides itself on defending civil liberties and combating discrimination. The ACLU has been at the forefront of progressive movements, fighting for equality and justice for marginalized communities for over a century.
