Former Employees At Kim Kardashian’s  Million Home File Lawsuit Against Her

Seven ex-employees of Kim Kardashian who worked at her $60 million home have sued her, accusing her of not properly paying them and not allowing them breaks so they could eat.

Andrew Ramirez, his brother Christopher Ramirez and son Andrew Ramirez Jr, along with Aron Cabrea, Rene Ernesto Flores, Jesse Fernandez and Robert Araiza are suing Kardashian.

The lawsuit states:

Defendants informed Plaintiffs that they were employees and withheld 10% of their gross wages for taxes. In reality, however, Defendants never remitted Plaintiff’s withholdings to the tax authorities. In fact, Plaintiffs were treated as independent contractors despite being told that they were employees of Defendants.

For example, Plaintiffs never received any paystubs, were not paid on regular periods, were not given their required meal and rest breaks, were not provided a means to record all their hours, were not reimbursed for employment expenses, were not paid all their overtime wages, and were not paid their wages upon termination of employment.

In addition, Plaintiff Andrew Ramirez was terminated when he inquired about his rights as an employee and Plaintiff Andrew Ramirez Jr. was employed as a sixteen-year-old minor, but worked longer than the maximum hours allowed to be worked by minors under the Labor Code.

Frank Kim, the attorney for the plaintiffs, stated, “Wage theft and other workplace violations are a widespread problem in Los Angeles. My firm is currently investigating other potential violations against these defendants, as well as other powerful families and businesses on behalf of everyday workers.”

Frank Kim is also representing hundreds of performers in their class-action lawsuit targeting Kim Kardashian’s estranged husband, rap star Kanye West, regarding working for him in his Sunday Service shows. “Allegations include not paying hundreds of employees on time, or ‘at all’ in some cases, as well as not granting the overtime wages, meal and rest breaks and business expenses to which they were legally entitled as employees in the state, rather than individual contractors,” The Daily Mail noted.

“A rep for Kim tells TMZ … she hired a third-party vendor for the ongoing maintenance/cleaning services, and she’s not privy to the agreement made between the vendor and the workers,” TMZ reported. “The rep insists Kim ‘is not responsible for how the vendor manages their business and the agreements they have made directly with their staff.’ The rep adds … ‘Kim has never not paid a vendor for their services and hopes that the issue between these workers and the vendor who hired them can be amicably resolved soon.’”

Page Six quoted “a source close to Kim” who stated, “She does not have a history of not paying her bills on time — never has and never will. She takes a lot of pride in paying people on time for their work so this issue has nothing to do with her and these workers are suing the wrong person. The lawyer for the employees was very careful not to include Kim’s name in his statement or directly mention any claims against her, because he knows these employees never worked directly for Kim, only through a third-party vendor.”
