Rep. Matt Gaetz Calls on Secretary of Homeland Security for Information on Illegal Immigrant Involved in Drunk Driving Incident
Rep. Matt Gaetz (R-Fla.) has raised concerns about an incident involving an illegal immigrant from Nicaragua who was involved in a drunk driving incident that injured a police officer in Virginia. Gaetz has called on Secretary of Homeland Security Alejandro Mayorkas for information regarding the immigration status of the individual.
The incident occurred on August 19 in Chesapeake, Virginia, during a traffic stop. Yacarely Diaz-Castro, the illegal immigrant, collided with a Chesapeake police officer while allegedly driving under the influence of alcohol. The officer suffered severe injuries, including a fractured skull and a C6 vertebrae fracture, which could result in a lifetime of physical impairment.

The 30-year-old illegal immigrant was charged with DUI maiming, driving without a license, and failing to move over for a stationary vehicle with warning lights. She appeared before a judge in August, and officers found empty beer cans in her vehicle, along with evidence of failing sobriety tests and a strong smell of alcohol. She did not possess a driver’s license.
In a letter to Secretary Mayorkas, Gaetz highlighted that Diaz-Castro had entered the United States illegally from Nicaragua seven months ago and claimed to have received a “Notice to Report” form from Immigration and Customs Enforcement (ICE). This form instructs recipients to report to ICE within 60 days.
Gaetz’s letter included seven specific questions for Secretary Mayorkas, seeking information about Diaz-Castro’s immigration status, her date of unlawful entry into the United States, any contact with ICE, and the number of illegal immigrants who have failed to comply with similar notices. He also requested details on the steps being taken by the Department of Homeland Security to ensure the swift removal of non-compliant illegal immigrants and the number of law enforcement and first responders injured by illegal immigrants in the past two years.
It is worth noting that nearly 2 million individuals who have crossed the border unlawfully have been released into American communities through President Joe Biden’s parole pipeline. In February, it was revealed that approximately 600,000 border crossers, including Diaz-Castro, had been issued notices to report (NTR) by the Department of Homeland Security. These NTRs resulted in their release into the interior of the United States without the obligation to appear before an immigration judge.
The Biden administration’s parole program allows tens of thousands of individuals from Cuba, Haiti, Nicaragua, and Venezuela to be released into the United States each month. Texas and 21 other states are leading a coalition to halt this program, arguing that it constitutes executive overreach and should be terminated.
Legal filings by Texas and its counterparts have criticized the administration’s program.
