A Brave Judge Stands Against Mask Mandates in Germany
In a bold move that has captured national attention, a German court has sentenced one of its own judges to prison for ruling against the government’s mask mandates.
In 2021, Judge Christian Dettmar made headlines when he struck down a local government ordinance that required schoolchildren to wear masks in the German state of Thuringia. However, his courageous decision has come at a great cost.
Judge Dettmar now faces the loss of his legal career and pension, along with a two-year suspended prison sentence for allegedly ”perverting the law.”
A Stand for Children’s Well-being
During the pandemic-era lockdowns, the Thuringian state government mandated that all children wear masks, maintain social distancing, and undergo virus tests while at school.
However, Judge Dettmar ruled that masks should not be mandatory for children at two schools in Weimar, Thuringia. This decision came after a concerned mother raised concerns about the negative effects of masks on her children’s health, including insomnia, nausea, and headaches.
With the welfare of the children in mind, Judge Dettmar informed the schools in Weimar that they could no longer enforce the mask mandate.
Unsurprisingly, the state government was outraged by Judge Dettmar’s ruling and demanded his punishment and removal from the bench.
The Higher Regional Court in Erfurt eventually overturned the judge’s decision, following a complaint by the state’s education department. Students were once again required to wear masks in schools.
The district court in Erfurt argued that only an administrative court had the jurisdiction to make such a ruling and that Judge Dettmar had overstepped his authority.
Despite the backlash, Judge Dettmar defended his decision, stating that he had consulted certified university experts before making his ruling.
Accusations and a Suspended Sentence
Unfortunately, Judge Dettmar’s suspension from the bench was not the end of his troubles.
State prosecutors took action against him, charging him with “perverting the law” and ruling on a matter outside of his jurisdiction.
During the trial, prosecutors argued that the judge had made his ruling as a political statement against lockdowns, rather than out of genuine concern for the children involved. They also accused him of deleting emails and files to cover up the true motive behind his decision.
A police raid on his home and office further revealed alleged bias against lockdown measures in his private correspondence.
Despite these accusations, Judge Dettmar maintained that he had consulted with scientists who were critical of the government’s measures at the time.
Currently, Judge Dettmar’s legal team is considering an appeal as he faces the possibility of dismissal from his duties as a judge, in addition to his suspended sentence.
According to German law, a civil servant sentenced to a custodial sentence of more than 12 months loses both their position and pension. The prosecutors, who initially sought a three-year sentence, are also appealing the ruling.
The defense argues that the trial was politically motivated and an attempt to silence dissenting voices.
Despite the challenges he now faces, Judge Dettmar remains steadfast in his belief that he made the right decision for the well-being of the schoolchildren in Weimar.
