Rudy Giuliani: From Mafia to RICO Charges
Rudy Giuliani, a former U.S. Attorney for the Southern District, made a name for himself in the 1980s by using RICO statutes to take down mafia and other criminals. In a recent radio interview, Giuliani reflected on the irony of his situation. Just a day after being charged under RICO statutes in Georgia for alleged election interference, he discussed his familiarity with the law on 77 WABC radio.
“I’m anxious to fight this case. First thing we should do is dismiss the indictment because it’s improperly filed. Number two, we should move for removal under 28 USC Section 1442,” Mr. Giuliani said.
Giuliani, along with former President Donald Trump and 17 other conspirators, was indicted for acts of racketeering and a total of 40 other counts. When his son called from Lithuania to ask how he was, Giuliani asked, “How does it feel to be in a free country?”

Giuliani argued that the case should be removed to federal court, emphasizing that the federal statutes support this move when indicting someone for actions related to federal office. He criticized Atlanta, where the indictment was filed, calling it a “crooked Democratic city” with a history of corruption.
Mark Meadows, former chief of staff for President Donald Trump, has already filed a motion to move the indictment to federal court. His lawyers argue that all the actions listed were taken in his official capacity as chief of staff.
Giuliani expressed his excitement about the upcoming fight, stating, “I woke up this morning more excited than I have been in weeks. Because I got a fight on my hands, and a justifiable one.” He reassured his family that he is prepared for this battle, drawing parallels to his past efforts in taking down the mafia.
‘Fictitious’ Indictment
Giuliani, like other legal experts, pointed out the suspicious handling of what appeared to be an early posting of an indictment against former President Trump. He described it as a sign of corruption and called for disbarment.
Reuters initially reported that the Georgia court posted, then removed, two pages listing several counts against President Trump while the grand jury was still hearing witness testimonies. The counts on the removed file later matched exactly the final indictment.
Giuliani scrutinized the document and highlighted the mistakes made in its handling. He criticized the lack of professionalism and ethical conduct displayed by the prosecution.
Despite the challenges ahead, Giuliani remains steadfast in his pursuit of justice. He affirmed, “I’m the same Rudy Giuliani that went after the mafia, I haven’t changed one bit. The country’s become fascist and communist, I haven’t.”
