A Call to Reject the Plea Deal: Hunter Biden’s Laptop Controversy
A nonprofit research group, Marco Polo, has taken a bold stance in the tax fraud case involving Hunter Biden. In a letter addressed to Judge Maryellen Noreika, the organization urges her to reject the plea deal offered by prosecutors. This plea deal, if accepted, would not only trivialize the severity of the crimes committed but also send a disheartening message to the public about the influence of nepotism and political power in our criminal justice system.
Marco Polo, known for its extensive analysis of the emails found on Hunter Biden’s laptop, has made its case clear. They argue that judges have the authority to refuse plea deals, even if both the prosecutors and the defendant agree on them. The organization emphasizes that the evidence found on the laptop points to at least 459 violations of state and federal laws and regulations. These violations include 140 business-related crimes, 191 sex-related crimes, and 128 drug-related crimes. The evidence supporting these claims includes emails, photos, videos, text messages, and audio files.
Marco Polo goes on to explain that the proposed plea deal is so inadequate that the term “limited hangout” fails to capture its true nature. A “limited hangout” is a public relations tactic used to admit to a small portion of wrongdoing in order to give the impression that the issue has been resolved. The organization argues that this plea deal falls far short of justice.
Giuliani’s Support and Allegations of Prosecutorial Misconduct
Joining Marco Polo in this plea to the judge is Rudy Giuliani, the former attorney for Donald Trump. Giuliani, with his experience as a United States Attorney, is uniquely qualified to identify a ”sweetheart” deal reserved for individuals like Hunter Biden, whose father is the president. The letter highlights that without Biden’s familial connections, no prosecutor would have proposed such lenient terms, including two misdemeanors and essentially a non-prosecution on the felony gun charge.
The letter also reveals that Robert Costello, Giuliani’s own lawyer and a former deputy in the New York prosecutor’s office, has signed the letter as well. Together, they raise concerns about prosecutorial misconduct surrounding the plea deal.
According to the letter, congressional oversight and whistleblower disclosures have shed light on potential misconduct. The plea deal, limited to misdemeanor tax charges, would allow a felony gun charge to be dismissed under a diversion program, with only probation as the penalty. The letter alleges that Assistant US Attorney Lesley Wolf, along with her colleague Mark Daly, leaked information to the Bidens, tipping them off about an imminent raid on a storage unit. This leak infuriated IRS investigators and potentially violated both Pennsylvania Bar rules and federal statutes. Furthermore, Wolf allegedly concealed evidence, discouraged inquiries about the U.S. president, and prioritized “optics” over investigative steps.
The letter also mentions that Hunter Biden’s lawyer, Chris Clark, warned prosecutors that their careers would be ruined if they pursued various charges against Hunter. Additionally, the letter points out that the proposed plea deal, charging Hunter Biden under 26 USC §7203 as a standalone misdemeanor, is unprecedented in the District of Delaware since 1995.
Finally, the letter highlights the upcoming testimony of Hunter Biden’s former business partner, Devon Archer, before the Oversight and Accountability Committee in the U.S. House of Representatives. The organization urges the court to consider this testimony before accepting the plea offer, emphasizing the importance of being fully informed about all relevant facts.
