Supreme Court Justice Neil Gorsuch Slams Sotomayor’s Dissent in Landmark Case

In a fiery exchange, Supreme Court Justice Neil Gorsuch criticized his colleague Sonia Sotomayor’s dissenting opinion on a recent ruling that upheld a Christian web designer’s right to refuse designing websites for same-sex weddings.

“It is difficult to read the dissent and conclude we are looking at the same case,” Gorsuch remarked.

Sotomayor, joined by Justices Elena Kagan and Ketanji Brown Jackson, argued that the court’s decision granted businesses the right to discriminate against protected classes. However, Gorsuch dismissed her claims, accusing her of distorting the facts presented in the majority opinion.

“For instance: While stressing that a Colorado company cannot refuse ‘the full and equal enjoyment of [its] services’ based on a customer’s protected status … the dissent assures us that a company selling creative services ‘to the public’ does have a right ‘to decide what messages to include or not to include,'” Gorsuch pointed out.

The case in question involved Lorie Smith, a Christian web designer who sued Colorado in 2016 for its laws that would have compelled her to create a website for a same-sex wedding, which she believed violated her religious beliefs and freedom of speech.

Gorsuch also addressed Sotomayor’s argument that the ruling undermined the progress made by the LGBTQ+ community. While acknowledging the importance of LGBTQ+ rights, Gorsuch emphasized that the dissent failed to address the central question at hand: whether the government can force an individual to express a message contrary to their beliefs.

“When the dissent finally gets around to that question — more than halfway into its opinion — it reimagines the facts of this case from top to bottom,” Gorsuch wrote.

Contrary to his colleagues’ claims, Gorsuch clarified that the ruling did not create a new right to refuse service to a protected class. Smith is still required by law to work with anyone, regardless of sexual orientation.

Ultimately, Gorsuch argued that the dissent would have required the court to take an unprecedented step by allowing the government to compel an individual to speak against their deeply held beliefs.
