Greg Abbott plans to pardon Daniel Perry

Greg Abbott, the Governor of Texas plans to grant a pardon to United States Army Sergeant Daniel Perry. This announcement comes one day after Perry was found guilty of murdering Garrett Foster during a Black Lives Matter demonstration in 2020.
The board’s spokesperson, Rachel Alderete, confirmed on Monday that they will commence an inquiry into the matter immediately and report to the governor with recommendations upon completion. However, the board did not specify the duration the investigation would take or whether there would be an appeal process before the verdict.
Daniel Perry, a White Army sergeant and ride-share driver, fatally shot Garrett Foster, a White man, during a Black Lives Matter protest in Austin, Texas, in 2021. Perry was charged with dangerous conduct and aggravated assault with a deadly weapon for his actions during the protest.
Perry claimed that he fired in self-defense after Foster approached his automobile with an assault rifle. He also argued that he had dropped off a client near the demonstration and was unaware of it because George Floyd, a Black parent, had died in detention the day before. Perry’s attorneys argued that he kept a weapon in his vehicle for protection while driving.
Last Friday, a Travis County jury found Perry guilty of murder. The county prosecutor’s office continues to investigate the deadly conduct charge even though the jury declared him not guilty of aggravated assault with a dangerous weapon.
On Saturday afternoon, Governor Greg Abbott tweeted that he was “working as swiftly as Texas law allows regarding the pardon of Sgt. Perry.” He further explained that Texas law permits the governor to appeal to the state’s pardon board to determine whether a pardon should be granted and that he had “made that request and instructed the Board to expedite its review.”
The Texas “Stand Your Ground” statute, which Abbott referred to as “one of the strongest” in the United States, was another topic of discussion. Under such laws, individuals are usually allowed to react to threats or force without worrying about facing legal consequences as long as they are present at a location legally recognized as theirs.
The prosecution alleged that Perry had initiated the confrontation by running a red light to join the demonstrators protesting against police brutality and had previously posted on social media about shooting protesters.
The Texas Legislative Black Caucus has released a statement on Twitter stating their opposition to the governor’s decision.
