Dismissal of Tax Charges Against Hunter Biden
U.S. District Judge Maryellen Noreika made a significant decision on Thursday evening, dismissing two misdemeanor tax charges against Hunter Biden. However, this move was not without controversy. Special Counsel David Weiss, newly appointed to the case, requested the dismissal of these charges in order to potentially file new charges against President Joe Biden’s son in either California or Washington, D.C.
In late July, Hunter’s plea deal, which involved alleged tax crimes and other illegal behavior, completely fell apart. Judge Noreika raised concerns about the extent of immunity granted to Hunter under the deal. The proposed agreement would have required Hunter to plead guilty to the now-dismissed tax misdemeanors and admit to a gun charge. If approved, this deal would have likely spared the president’s son from jail time and, according to Hunter’s team, shielded him from future legal action, essentially functioning as a de facto pardon.
Judge Noreika put the plea deal on hold, leading Hunter to plead not guilty. She requested that federal prosecutors and Hunter’s lawyers take the time to further negotiate the details of a new plea deal. Last Friday, Attorney General Merrick Garland appointed David Weiss as special counsel.
By Tuesday, Weiss’ team filed in court that the plea deal and its associated diversion program were “now-withdrawn” and “never went into effect.” This means that none of the terms of the deal are binding on either party, as reported by CNN.
Hunter’s attorneys agreed with Weiss’ request to dismiss the two tax misdemeanors, and Judge Noreika approved the request from both parties on Thursday.
However, critics of the special counsel argue that this new development provides further protection for Hunter and his father, potentially preventing key actors from testifying before Congress.

As columnist David Marcus points out, both Attorney General Garland and Special Counsel Weiss were expected to testify before Congress in the fall regarding whistleblower allegations. However, with the case now classified as an active investigation, they will likely decline to comment on the matter.
The House Oversight Committee has pledged to investigate the Biden family’s financial activities and interview witnesses to determine if foreign actors targeted the Bidens, if President Biden is compromised, and if our national security is at risk. They also aim to uncover misconduct within the Justice Department and hold those responsible accountable for abusing their law enforcement powers.
Oversight Chairman James Comer expressed concern over Attorney General Garland’s actions, accusing the Justice Department of attempting to cover up the Biden family’s involvement in lucrative deals with foreign nationals.
It remains uncertain what will happen to the original gun charges from Hunter’s now-void plea deal.
