A Last-Minute Play to Block Hunter Biden’s ‘Tainted’ Plea Deal
A top House Republican has made a bold move to prevent a federal judge from accepting a plea deal that would bring an end to Hunter Biden’s tax investigation.
Republican Rep. Jason Smith of Missouri, chair of the House Ways and Means Committee, filed a brief on Tuesday in U.S. District Court in Wilmington, Delaware. The judge is set to decide on Wednesday whether to accept the negotiated plea deal, as reported by The New York Times.
The plea deal, if accepted, would resolve the pending tax and gun charges against Hunter Biden without any jail time.
Hunter Biden’s lawyers attempted to prevent the filing of the brief, according to the Times. They argued that it contained confidential taxpayer information and should be sealed. Judge Maryellen Noreika agreed with this point.
“The situation here is not that the Justice Department exercised charging or plea negotiation discretion, but the presence of credible allegations that the investigation, charging decisions and plea negotiations were tainted by improper conduct at various levels of the government,”
Theodore A. Kittila, the lawyer who filed the brief on behalf of Rep. Smith, stated that there were serious concerns about the handling of the investigation and prosecution of the case. He emphasized the need for transparency and fairness in evaluating the plea agreement.
Rep. Smith’s filing also highlighted allegations of interference, delays, and roadblocks in the investigation. It pointed out that these actions had hindered the progress of the case and potentially led to the expiration of the statute of limitations on key claims.
The filing concluded by stating that the list of irregularities presented was just the tip of the iceberg, with numerous other examples of interference and delays provided by the whistleblowers.
Christopher Clark, a lawyer for Hunter Biden, dismissed the filing as ”baseless and abusive,” according to the Times.
After the filing, Judge Noreika threatened Hunter Biden’s attorneys with punishment for attempting to seal the brief and for a staff member misrepresenting herself. Hunter Biden’s legal team claimed it was an unintentional miscommunication.
As the court prepares to make its decision, House Republicans are making a last-minute effort to block what they perceive as a “tainted” plea deal for Hunter Biden.
