WOTUS FIGHT REENEWED Ahead OF SACKETT DECISION
Waters of America, also known as WOTUS, have seen significant regulatory changes in the three previous administrations. Court challenges have not been able to stop both Trump and Obama from revising the regulations.
Republicans favor the Trump-era rule. It limited the range of waters that could be subject to special permitting by Army Corps of Engineers or the Environmental Protection Agency. Democrats opposed it because it would lower environmental standards and allow for more pollution.
The case of the GOP is largely based on how farmers and businesses could be affected by Biden’s rule, which covers more water than Trump’s rule. Witnesses said that farming and homebuilding would be more difficult for the House Small Business Committee.
Roger Williams, Chairman of the Republican Party of Texas (R-TX), stated that the Biden rule would make it more difficult for entrepreneurs to do business.
