Hunter Biden’s legal team is fighting to have federal charges against him dismissed. These charges allege that he lied about his drug use on a federal form when purchasing a handgun back in 2018. Biden’s team argues that a previous plea deal made with the Department of Justice should still be in effect.
Biden maintains that the plea deal, which was previously thrown out by U.S. District Judge Maryellen Noreika, “remains in force,” according to his lawyer Abbe Lowell. In a recent filing, Biden seeks to have the charges he was arraigned for this week thrown out.
The charges against the president’s son involve three counts related to the gun purchase. Under the original plea deal, Biden would have pleaded guilty to two separate misdemeanor tax crime charges, and the gun charges would have been dropped by the federal government.
“He will seek to dismiss the Indictment against him pursuant to the immunity provisions of that Agreement,” stated Lowell in the filing.
Judge Noreika rejected the initial plea deal, expressing concerns about the broad immunity it offered to Biden. She instructed prosecutors and Biden’s legal team to come up with a new agreement, stating that the original deal was not standard and differed from what she typically sees.
When the original deal fell apart, Biden pleaded not guilty to the tax charges. There were reports that federal prosecutors were initially considering not charging Biden at all, but whistleblowers from the Internal Revenue Service came forward, alleging preferential treatment in the investigations.
