In a new⁢ filing, Mr. ⁣Weiss⁢ has asked Judge Noreika, another appointee of President Trump, to dismiss the case. However, if the request is granted, ⁢prosecutors have stated that they may bring the same charges ⁢or different ⁤ones in another‌ district.

Additionally, prosecutors have asked the judge to vacate her order for⁢ the parties⁢ to brief her on aspects of ‌the plea agreement, ‌as the case is no longer moving towards a guilty plea.

These allegations are‌ supported by documents, including internal IRS emails.

According to one ⁣of the whistleblowers, IRS agent Gary Shapley, Mr. Weiss stated during a 2022 meeting that he ⁢was not⁢ the ultimate authority on charging ‌decisions. He ⁢also allegedly mentioned that he had requested to be appointed as⁤ a⁣ special counsel, but the⁣ Department of Justice denied the request.
