Hunter Biden filed a broad countersuit against the owner of a computer repair shop in a legal action which escalates the dispute over the alleged unauthorized access to the son of the president that occurred nearly four years ago. Biden claimed that he had dropped his laptop and not picked it up by the shop owner.
Biden and his legal counsel stated that John Paul Mac Isaac was not entitled to copy or distribute private data in the counterclaim they filed in U.S. District Court Delaware on Friday morning. He was accused along with others of six counts for invasion of privacy, including conspiring to obtain and distribute data.
The document, which consists of 42 pages, provided extensive details about Hunter Biden’s data. This led to it being included in the 2016 election controversy.
Hunter Biden’s past includes lewd images and intimate audio. The lawsuit could bring more attention to his dark past.
Hunter Biden’s lawyers and he are trying to reframe this story partly with the countersuit. They put the emphasis on the private citizen whose privacy was invaded rather that a man who, according to his critics, exploited his father’s name and gained political influence.
“As a result of Mac Isaac’s unlawful agreement and his conspiracy with others, Mr. Biden’s personal data was made available to third parties and then ultimately to the public at large, which is highly offensive, causing harm to Mr. Biden and his reputation… The object of invading Mr. Biden’s privacy and disseminating his data was not for any legitimate purpose but to cause harm and embarrassment to Mr. Biden,” According to the suit.
This action comes in response to Mac Isaac’s own lawsuit, which he has amended numerous times. Hunter Biden claims that Hunter Biden defamed Hunter Biden, claiming that Hunter had illegally accessed his data. In fact, Mac Isaac says that the laptop became Hunter Biden’s property when it was left at his shop.
CNN, Politico, Senator Adam B. Schiff (D.Calif.), were also named as defendants.
James Comer (Republican from Kentucky), chairman of the House Oversight Committee, is currently preparing a high-profile investigation into President Barack Obama’s son. Hunter Biden’s response to his critics by launching an aggressive legal challenge of himself only escalates the conflict.
The dynamic may prove to be an awkward distraction for President Biden as he prepares for the announcement of his reelection bid in the coming weeks.
Hunter Biden requested a jury trial to determine compensatory and corrective damages. The lawsuit also requested that Mac Isaac and other defendants be ordered by the court to turn over any incomplete or duplicate copies of data belonging to President Biden’s child.
This is Hunter Biden’s first court document after his laptop was brought to the attention by the president’s political enemies. It displays a more aggressive stance than the legal team Hunter Biden recently assembled.
This is the first appearance of the legal team in court. They have previously sent cease and desist letters to different individuals.
Although the son-in-law of the president never stated explicitly that the laptop belonged him, he had to position himself carefully.
Hunter Biden, in his lawsuit, denies dropping off the laptop or having gotten an invoice. According to the lawsuit, Hunter Biden doesn’t have the knowledge required to either admit to or deny the allegations.
However, he acknowledges that he owns some of the information made public, and that Mac Isaac could be the one who acquired it in April 2019.
“This is not an admission by Mr. Biden that Mac Isaac (or others) in fact possessed any particular laptop containing electronically stored data belonging to Mr. Biden… Rather, Mr. Biden simply acknowledges that at some point, Mac Isaac obtained electronically stored data, some of which belonged to Mr. Biden,” The filing was made.
Hunter Biden claimed that Delaware law would have restricted Mac Isaac’s access or dissemination of data on the unclaimed notebook.
Mac Isaac and his comrades have often cited a signed receipt that stated that any property not claimed within the 90-day period would be forfeited.
Biden’s lawyers claimed that the agreement was flawed. Biden’s lawyers claimed that the boilerplate terms were at the bottom of the page. This was well below the signature line in small print.
Public notices asking for the owner’s return must be posted before personal property in Delaware is considered abandoned after a year.
Mac Isaac claimed that even if the laptop was abandoned, he would still have rights to the equipment, but not to any data.
“In fact, the Repair Authorization form states that the Mac Shop will make every effort to ‘secure your data… Reputable computer companies and repair people routinely delete personal data contained on devices that are exchanged, left behind, or abandoned. They do not open, copy, and then provide that data to others, as Mac Isaac did here,” The filing was completed.
