The indictment, handed down by the United States District Court for the District of Delaware, includes two counts of lying on a background check form and one count of possessing an unlawful firearm as an “unlawful user of and addicted to any controlled substance.”
If convicted, each charge carries a maximum penalty of 10 years in prison and a $250,000 fine.
Despite the charges, Kirk and Stamboulieh believe that Hunter Biden may escape serious penalties. They point to the lackluster pursuit of the charges by the government and a recent court decision that could complicate the third count.
