Special Prosecutor Seeks Protective Order Against Trump, Citing His Own Words
In a Friday court filing, special prosecutor Jack Smith aims to use former President Donald Trump’s own words to secure a protective order on his terms. This legal document outlines what a defendant can publicly say about the case.
Smith’s team is requesting that their proposed terms and conditions be adopted before the discovery phase of the case begins. During this phase, the government must share evidence with the defense to prepare their case against Trump, who faces charges of conspiracy and obstruction related to the 2020 presidential election.
The government’s request for a protective order cites a social media post from Trump on Friday. Trump wrote on his Truth Social platform, “IF YOU GO AFTER ME, I’M COMING AFTER YOU!”
“All the proposed order seeks to prevent is the improper dissemination or use of discovery materials, including to the public. Such a restriction is particularly important in this case because the defendant has previously issued public statements on social media regarding witnesses, judges, attorneys, and others associated with legal matters pending against him,” the filing said.
“If the defendant were to begin issuing public posts using details — or, for example, grand jury transcripts — obtained in discovery here, it could have a harmful chilling effect on witnesses or adversely affect the fair administration of justice in this case,” the filing added.
A representative of the Trump campaign stated that the Truth Social post had nothing to do with the case. However, the court has given Trump’s defense team until Monday to respond.
On Sunday, Trump hinted at his legal strategy on Truth Social, claiming that he cannot receive a fair trial with the current judge assigned to his case. He expressed his intention to request the judge’s recusal and a change of venue.
U.S. District Court Judge Tanya Chutkan, who has ruled against Trump in previous cases, including withholding records from the House Jan. 6 committee, has been known for her tough stance on Capitol incursion defendants.
