Smith’s court filing comes after recent events, including U.S. District Judge Tanya Chutkan granting Trump a temporary hold on his gag order. However, Trump’s subsequent attack on a potential witness, Mark Meadows, Trump’s former chief of staff, goes beyond acceptable boundaries, according to Smith.
In a post on Truth Social, Trump questions Meadows’ credibility as a witness, suggesting he wouldn’t lie to gain immunity. Smith argues that such comments pose a risk to the case against Trump and urges Judge Chutkan to reimpose the gag order.
Trump’s legal team has filed three motions this week to dismiss the election interference case, with Trump maintaining his innocence. The charges against him relate to alleged attempts to subvert the 2020 election, culminating in the January 6 Capitol riot.
The trial is scheduled for March 4, 2024, just before Super Tuesday, and Trump also faces three other criminal cases in Florida, New York, and Georgia.
