Former President Trump Faces Charges for Mishandling Classified Documents

Last week, special counsel Jack Smith announced charges against former President Donald Trump for his alleged mishandling of classified documents. However, this may not be the end of the legal troubles for the former president, as Smith is also investigating Trump’s involvement in the Capitol riot on Jan. 6, 2021.

Appointed by Attorney General Merrick Garland in November 2022, Smith is tasked with investigating both the classified documents allegations and the Capitol riot. Garland described the Capitol riot investigation as an “investigation into whether any person or entity unlawfully interfered with the transfer of power following the 2020 presidential election or the certification of the Electoral College vote held on or about January 6, 2021.”

Capitol Riot Investigation Continues

The investigation into the Capitol riot is still ongoing, with reports that Nevada Republican Party Chairman Michael McDonald and committee member Jim DeGraffenreid were seen going into the federal courthouse where the grand jury for the investigation regularly meets. McDonald was previously involved in a plan to send illegitimate electors to cast Nevada’s six electoral votes in the 2020 presidential election and had his cellphone seized by the FBI.

Smith offered a brief statement on Friday regarding the indictment of Trump on classified document charges but made no mention of the Capitol riot investigation. “Adherence to the rule of law is a bedrock principle of the Department of Justice. And our nation’s commitment to the rule of law sets an example for the world. We have one set of laws in this country, and they apply to everyone. Applying those laws. Collecting facts. That’s what determines the outcome of an investigation. Nothing more. Nothing less,” Smith said in his remarks last week.

Separate Investigation into Trump’s Alleged Attempts to Overthrow Election Results in Georgia

Aside from the ongoing investigations, Trump is also facing a separate investigation into his alleged attempts to overthrow the results of the 2020 presidential election in Georgia. Fulton County District Attorney Fani Willis has not provided a clear timeline for when charges may be brought, but reportedly told judges to limit in-person hearings for two weeks in the middle of August.
