Daniel Penny, the suspect in the NYC chokehold case involving Jordan Neely’s death, has been indicted and will soon face arraignment.

Former Marine Indicted for Killing Homeless Man on NYC Subway

Daniel Penny, a 24-year-old former Marine, is set to face his arraignment at the end of the month for the charges of killing homeless man Jordan Neely on a New York City subway.

Penny will appear before Judge Maxwell Wiley at the Manhattan Supreme Court on June 28. The borough district attorney’s office announced the charges of second-degree manslaughter and criminally negligent homicide. If convicted, Penny could potentially face up to 19 years in prison, as reported by the New York Post.

Penny’s Attorneys Vow to Clear His Name

Penny’s legal team has expressed their unwavering commitment to proving their client’s innocence.

“We’re fully committed to clearing Daniel Penny’s name. We have complete confidence that a trial jury, when presented with the evidence, will deem his actions on that train as fully justified,” stated Steven Raiser from the law firm Raiser & Kenniff.

Neely, a 30-year-old homeless man, was known for his Michael Jackson impersonations in Times Square. On May 1, he caused a disturbance on a train, shouting about his hunger, thirst, and despair. He even threw trash at fellow passengers, causing discomfort and prompting them to move away, according to a freelance journalist who was present.

Penny then intervened, approaching Neely from behind and placing him in a chokehold. Two unidentified individuals joined in restraining the homeless man. They continued to hold him down for several minutes until Neely stopped resisting, ultimately resulting in his death.

Penny’s lawyers released a statement a few days after the incident, asserting that their client’s actions were not intended to harm Neely. Instead, they claim Penny acted in self-defense and to protect others from a man experiencing a mental health episode.

“When Mr. Neely began aggressively threatening Daniel Penny and the other passengers, Daniel, with the help of others, acted to protect themselves until help arrived. Daniel never intended to harm Mr. Neely and could not have foreseen his untimely death,” the statement read.
