Judge denies special counsel’s request in Trump documents case.
Federal Judge Delays Hearing in Trump’s Classified Documents Mishandling Case
Federal district court Judge Aileen Cannon has agreed to delay a hearing in the case involving former President Donald Trump’s mishandling of classified documents. Originally scheduled for this Friday, the preliminary hearing has been rescheduled for July 18, according to ABC News.
The delay was requested by Walt Nauta’s attorney, Stanley Woodward, due to a timing conflict with a bench trial related to the Justice Department’s investigation of the Jan. 6 Capitol attack. Jay Bratt, the top federal prosecutor overseeing the case, opposed the delay, citing the strong public interest in the case proceeding as expeditiously as possible.

Cannon’s decision comes after a court filing by Trump’s attorneys seeking a delay in the trial itself until after the 2024 election. Special Counsel Jack Smith argued for a trial in December, stating that the case involves straightforward theories of liability and does not present novel questions of fact or law, as reported by The Washington Post.
Last month, Trump pleaded “not guilty” to all 37 counts in the DOJ’s 49-page indictment. His lawyers argued that the case involves untested legal questions regarding their client’s right to retain documents under the Presidential Records Act. They also highlighted the challenge of seating an unbiased jury when the defendant is a candidate for president.
Furthermore, the attorneys pointed out the extensive pre-trial discovery required due to the large volume of documents involved, including classified materials. Trump has accused President Joe Biden of using the Justice Department to target him as his chief political opponent in the 2024 election.
“This is called election interference and yet another attempt to rig and steal a presidential election. More importantly, it’s a political persecution like something straight out of a fascist or communist nation,” Trump said.
