Special⁣ Counsel Jack⁢ Smith filed a⁤ court document Wednesday evening asking a Washington,‌ DC federal judge to reimpose a⁤ gag order on former President Donald ⁢Trump and modify his terms of release.

“This is Jack Smith escalating this war of words and trying‍ to ⁤silence Donald Trump,” Julie Kelly, author of Declassified, ⁣told One America News.

Specifically, Smith and his team claimed that Trump needed his speech restricted in‍ order to protect possible trial witnesses and ⁤court ‌staff from “intimidation, harassment, and threats.”

“What the government wants ‍now is for her to enforce or modify more‌ stringent, ⁢stricter conditions of release,” Kelly said.⁣ “So if [Trump] says something like he ⁣did about Mark‌ Meadows, that⁤ would technically violate the conditions of ‌release and could result in a fine, could result‌ in ⁤home⁢ detention, could result in prison time if ‌he does it more than once.”

Smith asked Judge Tanya Chutkan to “modify [Trump’s] conditions of release by making compliance with the Order a condition or ‍by clarifying that the existing‌ condition⁣ barring communication with witnesses‍ about the facts of the case includes indirect messages to witnesses made publicly on social⁣ media⁣ or⁣ in speeches.”

Chutkan imposed a gag order⁤ last week on ‌Trump only to temporarily pause it after Trump’s legal team filed ⁢an appeal. ‍After the gag‌ order was suspended, Smith highlighted a post that Trump made on ⁣Truth Social regarding a⁣ news report that the former White House Chief of Staff took a deal and⁢ was set to ⁣testify against Trump.

Julie Kelly: Jack Smith Aims to Restrict Trump with Gag Order & Altered Release Terms

Smith claimed this Truth Social⁤ post was Trump attempting‌ to send an “unmistakable and threatening message to a foreseeable⁢ witness in this ⁣case.” Kelly refutes this allegation.

“Think of the total situation here,” Kelly said. “You have a leak ⁢to the news media, one ‌that Mark Meadow’s ⁢team has denied. Someone probably with Jack Smith’s ⁤office leaks this to ‍a major ‌news⁤ organization.⁣ They post it. ⁣It goes viral, and then Mark Meadow’s team ‍denies it. But Donald Trump ⁤can’t say‍ anything about it. He can’t ⁢even respond publicly. His lawyers can’t ⁤respond publicly.”

“This ‌is another⁤ kicker in this proposed gag order, meaning associates or anyone who Trump allegedly directed to respond,” Kelly continued. “So this isn’t just Trump. It’s⁤ his lawyers and other people tied to ‍his‌ campaign, maybe family members. We don’t know. That’s how vague and broad this gag order is.”

What is the purpose of the recent request for a ‌gag order on former President Donald Trump in‍ his civil fraud trial?

Former President ⁢Donald Trump Faces New Request for Gag Order in Civil Fraud Trial

In a recent‌ development, Special Counsel Jack Smith has filed a court document requesting a gag order be reimposed on former President Donald Trump, along with modification of his terms of release. The request was made in ‍order to protect potential trial witnesses and court ‍staff from potential intimidation, harassment, and threats.

Smith argued that Trump’s speech should be restricted in order to ensure a fair trial and prevent ⁣any interference with ⁤the judicial process. However, critics have viewed this ⁣move as an attempt to silence Trump and limit his ability to speak out on matters related to the ongoing legal proceedings.

Notably, Julie Kelly, author of Declassified, expressed her concern⁤ regarding the government’s intentions, stating, “This is Jack Smith escalating this war of words and trying to silence Donald Trump.” ‍She further added that the proposed modifications to Trump’s release conditions could result in fines, home detention, or even prison time if violated.

Smith has asked Judge Tanya Chutkan to either enforce or clarify the existing conditions of release, ‌particularly the one that bars Trump‌ from communicating with witnesses about the facts of the case, including‍ indirect messages made publicly on social⁢ media or in speeches. This request comes after Chutkan initially ‍imposed a⁤ gag order on Trump, which was temporarily suspended⁤ following an appeal by his legal team.

The⁣ suspension of‌ the gag order ‌allowed Trump to make⁣ a post on his newly launched social media platform, Truth Social, addressing a news report about his former White House Chief of Staff taking a deal and potentially ‍testifying against him. Smith claimed that this post was an attempt⁢ by Trump to⁢ send a threatening message to a potential witness in the case, an allegation that Kelly vehemently denies.

Kelly highlights the complexity‌ of the situation by pointing out that while leaks to the media are taking place, Trump and his legal team are unable to publicly respond⁤ or defend their position due to the proposed gag order. ‍She also raises concerns about the vague⁣ and broad nature of the‌ order, noting that it⁢ could potentially affect not only Trump but also his lawyers, associates, and family members.

The ongoing legal battle between ‍Trump and⁤ the Special‍ Counsel continues to generate debate and speculation.⁣ It remains to⁢ be seen how the court will rule on the request‌ for a⁣ gag⁢ order and the modification of Trump’s conditions of release. Until then, the former president and his legal team must navigate⁣ the complexities of ‍the justice system ⁤while ⁤seeking a fair trial and the right to defend their case.
