In the latest indication that the Trump Department of Justice wants a truce in former President Joe Biden’s war on those involved in the Jan. 6, 2021, Capitol riot, federal lawyers for the first time have signaled support for settlement talks in the Ashli Babbitt wrongful death suit.
After months of fighting the suit brought by the husband of the retired Air Force veteran shot dead by a United States Capitol Police officer as she entered the Speaker’s Lobby off the House floor, Justice changed its tune last month, according to a new court filing.
“The parties have agreed to work in good faith to narrow or resolve issues in this case,” said the latest filing agreed to by Justice lawyers and Washington-based Judicial Watch, which is handling the suit for Babbitt’s estate and her husband, Aaron Babbitt.
The wording is the first to suggest settlement negotiations are underway in the $30 million lawsuit filed by Judicial Watch last January.
It follows the pardoning by President Donald Trump of the hundreds charged and convicted of participating in the riots described by liberals as a threat to democracy and conservatives as a protest to Biden’s election over Trump in 2020.
While Judicial Watch President Tom Fitton would not discuss the talks, he told Secrets, “All we want is justice and we hope the Justice Department under President Trump would share that goal ultimately.”
While there were violent clashes that day as protesters tried to enter the Capitol and disrupt the certification of Biden’s election, only Babbitt was shot by the police.
Her case was swept under the rug by the Democrat-led House Jan. 6 investigation, and the Capitol Police ended up promoting the shooter, Capt. Michael Byrd.
Fitton’s Judicial Watch has unleashed a flurry of Freedom of Information Act lawsuits that have shown how the Capitol Police tried to hide Byrd after the shooting. The prominent legal group also won the release of documents calling into question his performance and training.
In a video released by the legal watchdog, the unarmed Babbitt is shown being pushed through a doorway into the Speaker’s Lobby as Byrd shot without warning.

According to the suit, “Ashli remained conscious for minutes or longer after being shot by Lt. Byrd. Ashli experienced extreme pain, suffering, mental anguish, and intense fear before slipping into pre-terminal unconsciousness. The autopsy report identified the cause of death as a ‘gunshot wound to left anterior shoulder’ with an onset interval of ‘minutes.’ The fact that Ashli was alive and conscious in extreme pain and suffering is documented in videos of the shooting. Furthermore, nothing about the wound track described in the autopsy report would be expected to result in immediate death or instantaneous loss of consciousness, and Ashli’s lungs contained blood, further confirming that she was alive and breathing after being shot. Ashli was pronounced dead at Washington Hospital Center at 3:15 p.m. The medical examiner determined that the manner of death was homicide.”
A settlement could end the suit against the government, though details of the negotiations have not been revealed.
