The investigation into these school districts was conducted by Parents Defending Education (PDE), which discovered explicit policies stating that parents should be kept in the dark about their child’s claimed alternative gender. PDE Vice President Caroline Moore expressed hope that holding districts accountable for these policies would give parents a sense of empowerment and encourage change in Kansas and beyond.
Kobach sent letters to the school districts and the Kansas Association of School Boards, highlighting the policies that prohibited the disclosure of a student’s transgender status or gender nonconforming presentation to parents and other school personnel, unless legally required or authorized by the student.
While some districts argue that their policies comply with the law, Kobach called out the Kansas Association of School Boards for their involvement in pushing these policies, citing evidence from Belle Plaine documents. Kobach also sought information from the Kansas Association of School Boards regarding their support for these policies, the personnel involved in drafting them, and the lawyers and medical professionals consulted during their creation. However, the organization has not responded to his inquiries.
