The state of Kansas has made a controversial decision to no longer allow transgender residents to change the sex listed on their birth certificates. This move comes after a recent law was passed, requiring entities like the state health department to identify individuals based on their sex assigned at birth. Previously, a consent ruling from a state court had allowed residents to modify their birth certificates, resulting in around 400 individuals taking advantage of this opportunity.
Republicans Push for Change
In a bid to reverse this policy, Kansas Republican Attorney General Kris Kobach requested the vacation of certain parts of the consent judgment. In August, a judge granted this request, although the constitutionality of the new law was not explicitly addressed. The law officially came into effect on July 1, despite opposition from Democrats.
Lambda Legal, the firm that represented transgender clients in enacting the policy in 2019, claimed that the process had been smooth and without incident. However, they are now considering their next steps to ensure the rights of transgender Kansans to have identity documents that align with their true selves.
Despite her disagreement with the law, Governor Laura Kelly (D-KS) has committed to following it.
