Texas Attorney General Ken Paxton’s Attorneys File Motions to Dismiss Impeachment Charges
Just before the deadline, Texas Attorney General Ken Paxton’s attorneys filed two motions to the state Senate, aiming to dismiss certain evidence and charges brought against him.
Motion to Dismiss Inadmissible Evidence
Paxton’s attorneys argue that a $25,000 campaign donation from Natin “Nate” Paul should be deemed irrelevant and inadmissible. They state that this evidence falls outside the scope of admissible evidence and should be excluded from the trial. They also emphasize that admitting such evidence would enable prosecutors to employ ”abusive trial tactics.”
“Admission of campaign-donation evidence could create a false impression that money was exchanged for some official act, even though such an exchange never occurred,” the motion reads. “The Texas Rules of Evidence unequivocally bar such abusive trial tactics.”
Motion to Dismiss Article V: Disregard of Official Duty
The second motion seeks to dismiss the charge that Paxton committed an official disregard of duty under Article V. Paxton’s attorneys argue that this charge is unprecedented in 500 years of parliamentary procedure and does not constitute an impeachable offense.
“No legislature sitting as a court of impeachment has ever suggested that an elected official’s formation of an employment contract with a subordinate attorney rises to the level of a ‘grave official wrong,'” the attorneys state.
They further assert that Paxton is entitled to acquittal as a matter of law on Article V and urge the court to dismiss it.
Friday’s filing comes after a week of intense legal battles for Paxton, who is facing allegations of bribery, abuse of power, and retaliation against whistleblowers. Earlier in the week, his lawyers argued that most of the charges should be thrown out due to voters’ prior knowledge of the allegations and the timing of the actions in question.
