America First Legal Sues DOJ Over Hunter Biden’s Failure to Register as Foreign Agent
America First Legal (AFL) has taken legal action against Attorney General Merrick Garland and the U.S. Department of Justice for their failure to require Hunter Biden to register under the Foreign Agent Registration Act (FARA) during the Obama administration.
AFL recently obtained emails through a lawsuit against the National Archives and Records Administration (NARA) that confirm Hunter Biden’s direct representation of Ukrainian energy company Burisma while his father was in office.
“Hunter acted as a board member of the company — which fits the definition of a ’foreign principal’ under 22 U.S.C. § 611(b) — and served as an attorney at the law firm hired to represent it. Therefore, AFL argues, Hunter acted as an agent of a foreign company and is subject to FARA registration as he represented Burisma’s interests.”
The lawsuit claims that Garland did not enforce the proper registration requirements or provide a FARA waiver for Hunter Biden.
Furthermore, recent email correspondence released by the National Archives confirms Hunter’s involvement in a phone call between his father and the former Ukrainian President.
While others have faced legal consequences for failing to register as foreign agents, Hunter Biden has not received similar treatment for his business relationships with Chinese companies. The Senate Committee on Homeland Security and Governmental Affairs and the Senate Committee on Finance have previously released reports outlining the financial arrangements between the Biden family and their Chinese business partners.
AFL’s vice president and general counsel, Gene Hamilton, criticized Garland’s handling of the situation, stating, “The Attorney General has a non-discretionary duty to ensure that Hunter Biden registers as a foreign agent under FARA and provides the American people with transparency into his activities on behalf of foreign principals.”
The DOJ has faced additional scrutiny as federal prosecutors and the FBI allegedly interfered with an IRS investigation into Hunter Biden. This has led to calls for an overhaul of the FBI to address its biased practices.
Garland continues to deny any special treatment given to Hunter Biden by the DOJ.
