The Ongoing Legal Battle in the Delphi Murders Case

Carroll County Prosecutor Nicholas McLeland has provided a list of witnesses and exhibits to Richard Allen’s defense attorneys, Brad Rozzi and Andrew Baldwin. McLeland has also requested that Special Judge Frances Gull, whom Allen’s defense attorneys attempted to have removed from the case, order the attorneys to submit their witness and exhibit list by March 7. It remains unclear whether Gull has issued the order.
Allen was initially charged in October 2022 with two counts of murder and kidnapping in relation to the deaths of 13-year-old Abby Williams and 14-year-old Libby German. McLeland later filed a request to amend the charges, adding two additional counts of murder and two counts of kidnapping, according to WTHR.
The contempt claims were filed by McLeland on January 29. In response, Baldwin and Rozzi’s attorney, David Hennessy, filed a motion seeking clarification on the allegations, arguing that they lacked sufficient evidence.
One example highlighted by Hennessy was McLeland’s accusation that his clients violated the court’s order regarding statements about the case. Hennessy pointed out that the alleged violation occurred before the court issued a gag order, questioning how it could be considered contempt of court.
McLeland has not directly addressed Hennessy’s points. If found in contempt, Rozzi and Baldwin could face fines or incarceration, as reported by the Courier.
Judge Gull’s Controversial Actions
Judge Gull had previously compelled the defense attorneys to withdraw from the case, and the circumstances surrounding their withdrawal were presented to the Indiana Supreme Court. During a closed-door meeting with Gull, the attorneys claim that she threatened to harm their reputation by accusing them of “gross negligence” in open court unless they withdrew. The attorneys complied but filed a petition to represent Allen pro bono. However, Gull subsequently barred them from representing Allen in any capacity.
The transcript, obtained by WTHR, reveals that Gull had planned to remove the two attorneys before publicly announcing their withdrawal. The meeting, which included McLeland, also discussed a leak of documents from Baldwin’s office. However, Gull stated that the leak was not the sole reason for wanting the attorneys removed, suggesting potential violations of professional responsibility rules and inadequate cooperation with a gag order.
During the meeting, Rozzi expressed his frustration, feeling ambushed and forced into a “forced resignation” without adequate notice or preparation. He believed that the options presented to him were to either withdraw or face public shaming. Despite their attempts to have Judge Gull removed from the case, their request was denied, but they were eventually reinstated as Allen’s attorneys.
