Manhattan District Attorney’s Office Opposes Trump’s Bid to Remove Judge in Criminal Prosecution
The Manhattan District Attorney’s Office has filed a response opposing former President Donald Trump’s motion to recuse New York State Supreme Court Justice Juan Merchan from overseeing his criminal prosecution. Trump is facing 34 felony counts related to alleged falsification of business records in connection to a hush payment made to Stormy Daniels before the 2016 election.
In their filing, prosecutors highlighted Trump’s history of baselessly accusing judges of bias and argued against granting his motion. They stated that granting the recusal would set a precedent for defendants to choose their own judges, undermining the integrity of the judicial system.
Trump’s claims of bias are based on Merchan’s daughter’s past work for Democrats and the alleged financial benefit the judge would gain from a conviction. However, prosecutors countered that these claims are unfounded and that the judge’s involvement in plea discussions with another individual involved in the case was completely proper.
In addition to seeking the recusal, Trump is also attempting to move his case from state court to federal court. A hearing on this matter is scheduled for next week.
