The Heritage Foundation Files Lawsuits Against Manhattan District Attorney Alvin Bragg
The Heritage Foundation, a conservative think tank based in Washington, D.C., has taken legal action against Manhattan District Attorney Alvin Bragg. The foundation filed two lawsuits on Monday in an effort to obtain records related to Bragg’s investigation into former President Donald Trump.
The lawsuits were prompted by Bragg’s failure to comply with two Freedom of Information Law (FOIL) requests. These requests sought information regarding Bragg’s communications with the Justice Department, the White House, and Democratic lawmakers in relation to the prosecution of Trump.
Charges Against Trump and Suspected Communication with the DOJ
In April, Bragg and his office charged Trump with 34 counts of falsifying business records. These charges stem from hush money payments made to adult film star Stormy Daniels during the 2016 presidential election. Trump has pleaded not guilty to the charges.
The first lawsuit filed by the Heritage Foundation alleges that Bragg’s suspected communication with the DOJ resulted in several House GOP committee investigations. The foundation expresses concerns about potential coordination between Trump’s political opponents and the criminal justice system.
“Regrettably, these questions have not been met with answers. These reports have raised concerns in many circles based in large part upon the longstanding history of President Trump’s political opponents coordinating their activities to systematically weaponize the criminal justice system against him and thereby pervert the course of Justice,” the first lawsuit obtained by the Washington Examiner stated.
Pro-Bono Assistance and Request for Documents
The second lawsuit filed by the Heritage Foundation claims that Bragg’s office received pro-bono assistance from major law firms. The foundation is seeking documents related to these firms and is asking the court to prevent Bragg’s team from seeking costs and fees for the FOIL request in question.
Trump’s legal team is also taking action to move the case out of the hands of New York Supreme Court Justice Juan Merchan. They are either requesting a transfer to federal court or demanding Merchan’s recusal.
